2.2 They should be read alongside our:
- Privacy Policy
- Cookie Policy
- Refund and Cancellation Policy
- any course-specific joining instructions, assessment criteria or candidate guidance issued by DIA Academy.
2.3 By purchasing or participating in the course, you confirm that you have read and accepted these Terms.
2.4 DIA Academy may update these Terms from time to time. Changes will not retrospectively remove any statutory rights you have in relation to a purchase already made.
3. Course structure
3.1 The DIA Fleet Trainer Course may include:
- online learning and study;
- fleet theory training and assessment;
- an advanced or fleet driving assessment;
- practical in-vehicle training;
- trainer development;
- a final training and assessment element at DIA’s Crawley training centre; and
- any other learning or assessment activities specified within the course programme.
3.2 Candidates are responsible for familiarising themselves with the course structure, requirements and assessment standards.
3.3 Purchasing the course does not guarantee successful completion, certification or acceptance onto any external register.
3.4 Candidates must successfully meet all required standards and complete all mandatory elements of the programme before DIA Academy will issue any relevant course completion certificate.
4. Candidate eligibility and responsibilities
4.1 Candidates are responsible for ensuring that they meet any eligibility requirements specified for the course before purchasing or attending.
4.2 Where the course requires a valid driving licence, ADI registration, insurance, vehicle or other professional qualification, the candidate must ensure that these remain valid for the relevant part of the programme.
4.3 Candidates must provide accurate and complete information when registering for the course and throughout their participation.
4.4 Candidates must inform DIA Academy promptly of any change that may affect their eligibility or ability to participate safely or lawfully.
4.5 DIA Academy reserves the right to request reasonable evidence of eligibility, identity, licence entitlement, insurance or other required documentation.
4.6 Failure to meet an eligibility requirement may result in a candidate being unable to undertake training or assessment. This will not automatically entitle the candidate to a refund.
5. Prices and payment
5.1 Course prices are those displayed on the Website or stated in the relevant booking materials at the time of purchase.
5.2 Unless an alternative payment arrangement has been agreed in writing, payment must be made before access to the course or Services is provided.
5.3 Price changes will not affect a confirmed and fully paid booking.
5.4 Any additional charges arising from reassessments, additional training, replacement sessions or other candidate-requested Services will be explained before they are booked.
6. Cancellation and refunds
6.1 Candidates may request cancellation of their course purchase within 14 days of purchase, subject to applicable consumer rights and any provisions relating to digital content or Services which have already begun.
6.2 After 14 days from the date of purchase, the course fee is non-refundable, except where DIA Academy is required by law to provide a refund.
6.3 Where a candidate requests or agrees to immediate access to digital course content or commencement of Services during the statutory cancellation period, their cancellation rights may be affected in accordance with applicable consumer law.
6.4 All cancellation requests must be made in writing to DIA Academy.
6.5 Failure to complete the course, failure to attend booked training or assessments, or a decision by the candidate not to continue does not create an automatic entitlement to a refund.
6.6 Failure of an assessment does not entitle the candidate to a refund of the course fee.
7. Assessment requirements
7.1 The course contains mandatory assessments which must be completed to the required standard.
7.2 Candidates are responsible for preparing appropriately for each assessment and ensuring they understand the relevant assessment criteria.
7.3 DIA Academy’s appointed assessors will determine whether the required standard has been achieved.
7.4 Assessment decisions will be based on the candidate’s performance against the applicable assessment criteria and standards.
7.5 Successful completion of one element of the course does not guarantee successful completion of any subsequent element.
8. Assessment attempts and reassessments
8.1 A candidate who does not achieve the required standard in an assessment will be required to undertake a reassessment if they wish to continue towards successful completion of the course.
8.2 Reassessments are not included within the original course fee unless expressly stated otherwise.
8.3 Candidates requiring a reassessment will be offered the relevant reassessment at a discounted candidate rate applicable at the time of booking.
8.4 Candidates are permitted a maximum of three attempts at each individual assessment forming part of the course.
8.5 The maximum of three attempts includes the candidate’s initial assessment and any subsequent reassessments.
8.6 If a candidate does not achieve the required standard after three attempts at an assessment, they will not be permitted to continue through the course under their existing enrolment.
8.7 In these circumstances, DIA Academy may discuss appropriate development or training options with the candidate. Any further course enrolment, training or assessment will be subject to DIA Academy’s agreement and may incur additional fees.
8.8 Course fees and reassessment fees already paid will not be refunded because a candidate has reached the maximum number of assessment attempts.
9. Progression to final in-car training and assessment at Crawley
9.1 The final in-car training and assessment element of the course takes place at DIA Academy’s Crawley training centre unless DIA Academy advises otherwise.
9.2 Before a candidate may book the final in-car training and assessment element at Crawley, they must have successfully passed both of the following assessments:
- the Fleet Theory Assessment; and
- the required Driving Assessment.
9.3 Candidates who have not successfully passed both assessments will not be permitted to book or attend the final in-car training and assessment element.
9.4 DIA Academy may specify additional reasonable progression requirements that must be satisfied before a candidate attends the final element of the course.
9.5 DIA Academy reserves the right to cancel, postpone or refuse a candidate’s attendance where the required preceding elements have not been successfully completed or where the candidate has not otherwise satisfied the requirements of the course.
9.6 Candidates remain responsible for ensuring that all mandatory course elements are successfully completed within the course completion period set out in section 18.
10. Booking training and assessments
10.1 Training and assessment places are subject to availability.
10.2 Candidates should not make non-refundable travel, accommodation or other arrangements until their training or assessment booking has been confirmed by DIA Academy.
10.3 DIA Academy may change an instructor, assessor, vehicle, venue, date or other delivery arrangement where reasonably necessary.
10.4 Where DIA Academy has to cancel or materially rearrange a session, we will take reasonable steps to offer an alternative.
10.5 DIA Academy is not responsible for travel, accommodation, loss of earnings or other third-party costs incurred by candidates except where liability cannot lawfully be excluded.
11. Candidate cancellations and non-attendance
11.1 Candidates must give DIA Academy as much notice as possible if they are unable to attend a booked training or assessment session.
11.2 Cancellation, rearrangement and non-attendance charges may apply in accordance with the booking information or Refund and Cancellation Policy in force at the time.
11.3 Failure to attend a booked assessment without sufficient notice may result in the assessment being treated as an assessment attempt and/or the candidate being required to pay a further assessment fee before another appointment can be arranged.
11.4 DIA Academy may waive or reduce charges in exceptional circumstances at its discretion. Any such decision does not create an obligation to do so in other cases.
12. Fitness to participate
12.1 Candidates must attend practical training and assessments fit to drive, learn and participate safely.
12.2 Candidates must not attend an in-vehicle element if they are affected by alcohol, illegal drugs, medication, illness, fatigue or any other condition which may make participation unsafe or unlawful.
12.3 Candidates must inform the trainer or assessor of anything relevant to the safe delivery of the session.
12.4 DIA Academy, its trainers and its assessors reserve the right to stop, postpone or refuse to commence training or an assessment where they reasonably consider that continuing would be unsafe, unlawful or inappropriate.
12.5 Where a session cannot proceed because the candidate is not fit or eligible to participate, the candidate may be required to pay for a replacement session or reassessment.
13. Vehicles used for training or assessment
13.1 Where a candidate is required or permitted to provide a vehicle, that vehicle must be legal, roadworthy, appropriately insured and suitable for the training or assessment being undertaken.
13.2 DIA Academy or an appointed trainer or assessor may refuse to use a vehicle where they reasonably consider it unsafe, unsuitable or non-compliant.
13.3 Where an assessment or training session cannot proceed because a candidate-provided vehicle does not meet the required standard, the candidate may be required to pay for a replacement booking.
13.4 Candidates are responsible for checking any vehicle requirements provided in their joining instructions before attending.
14. Conduct and professional standards
14.1 Candidates are expected to behave professionally and respectfully towards DIA Academy staff, trainers, assessors, other candidates and members of the public.
14.2 DIA Academy will not tolerate threatening, abusive, discriminatory, intimidating or unsafe behaviour.
14.3 Candidates must follow reasonable instructions given by trainers and assessors, particularly where those instructions concern safety.
14.4 DIA Academy reserves the right to remove a candidate from a session or the course where their conduct presents a safety risk, seriously disrupts training, breaches these Terms or amounts to serious misconduct.
14.5 Removal from the course because of serious misconduct will not normally result in a refund.
15. Academic and assessment integrity
15.1 Candidates must complete their own learning and assessments.
15.2 Cheating, impersonation, falsification of evidence, unauthorised assistance or any other attempt to compromise the integrity of an assessment is prohibited.
15.3 DIA Academy may invalidate an assessment result where it has reasonable grounds to believe that assessment integrity has been compromised.
15.4 Serious or repeated breaches may result in removal from the course without refund.
16. Course completion and certification
16.1 A candidate will only be considered to have successfully completed the DIA Fleet Trainer Course when all mandatory learning, training and assessment requirements have been completed to the required standard.
16.2 Attendance alone does not constitute successful completion.
16.3 DIA Academy reserves the right to withhold certification where mandatory course elements, assessments, payments or reasonable administrative requirements remain outstanding.
16.4 Any certificate issued confirms successful completion of the DIA Academy course requirements applicable at that time.
17. DVSA Fleet Register and third-party requirements
17.1 Successful completion of the DIA Fleet Trainer Course does not automatically place a candidate on the DVSA Fleet Register. Candidates are responsible for making the appropriate application to DVSA.
17.2 DVSA requires a trainer who has successfully completed the DIA Fleet Trainer Course to apply to join the DVSA Fleet Register within 12 months of the date on which they successfully completed the course.
17.3 Candidates must hold the appropriate DIA Fleet Trainer Course completion certificate as evidence of successful completion when applying to join the DVSA Fleet Register.
17.4 Candidates are responsible for ensuring that their application is made within the required DVSA timescale and that they satisfy any other eligibility, documentation, application or payment requirements imposed by DVSA.
17.5 DIA Academy cannot guarantee that a candidate will be accepted onto, or remain on, the DVSA Fleet Register. The decision whether to accept an application rests with DVSA.
17.6 If a candidate fails to apply to the DVSA Fleet Register within the required 12-month period, any consequences arising from this are the responsibility of the candidate. DIA Academy is not responsible for any requirement imposed by DVSA for the candidate to undertake further training or assessment.
17.7 DVSA may change its Fleet Register requirements, application procedures, eligibility criteria or timescales. Such changes are outside DIA Academy’s control.
18. Course completion period
18.1 The DIA Fleet Trainer Course must be fully completed within 12 months of the original date of purchase.
18.2 Full completion means successfully completing all mandatory elements of the course, including the required learning, Fleet Theory Assessment, Driving Assessment, final in-car training and final assessment.
18.3 Candidates are responsible for managing their progress through the course and allowing sufficient time within the 12-month period for training, assessments and, where necessary, reassessments.
18.4 Candidates should take into account that training and assessment appointments are subject to availability. Candidates are therefore strongly advised not to leave mandatory training or assessments until close to the end of their 12-month completion period.
18.5 The requirement to complete the course within 12 months applies regardless of whether the candidate has completed or successfully passed individual elements of the course during that period.
18.6 If the candidate has not successfully completed the entire course within 12 months of the original purchase date, their course enrolment will expire.
18.7 Once the course enrolment has expired, previous training and assessment passes achieved as part of that enrolment will not carry forward to a new enrolment.
18.8 A candidate wishing to continue after their 12-month course period has expired will be required to purchase the full DIA Fleet Trainer Course again at the price applicable at that time and restart the programme from the beginning, including completing the required training and assessments again.
18.9 No refund or credit will be provided for an expired course or for training and assessments previously completed under the expired enrolment.
18.10 DIA Academy may consider exceptional circumstances affecting course completion where required by law or where DIA Academy, at its discretion, considers an extension appropriate. Any extension agreed by DIA Academy must be confirmed in writing and does not establish a right to an extension for other candidates.
19. Course and assessment changes
19.1 DIA Academy may make reasonable changes to course content, delivery methods, trainers, assessors, venues, assessment procedures or learning materials where required to maintain standards, respond to regulatory changes or improve the programme.
19.2 Where DVSA, legislation, accreditation requirements or relevant professional standards change, DIA Academy may amend the programme or assessment requirements accordingly.
19.3 DIA Academy will take reasonable steps to minimise unnecessary disruption to candidates already undertaking the course.
20. Online learning and accounts
20.1 Some elements of the course require candidates to create or use an online account.
20.2 Candidates are responsible for keeping their login details secure.
20.3 Course accounts and access are personal to the registered candidate and must not be shared.
20.4 DIA Academy may suspend or terminate online access where these Terms are breached, misuse is suspected or access is being shared without permission.
20.5 Candidates are responsible for providing suitable equipment, software and internet access for online elements of the course.
21. System availability and data loss
21.1 DIA Academy takes reasonable steps to maintain its online systems but cannot guarantee uninterrupted availability.
21.2 Candidates should retain copies of any materials or records that they are permitted to download.
21.3 To the extent permitted by law, DIA Academy is not liable for loss of data, loss of course progress or interruption caused by technical failures, maintenance, cyber incidents, third-party platforms or circumstances outside our reasonable control.
21.4 This does not affect liability which cannot lawfully be excluded.
22. Intellectual property
22.1 Course materials, videos, presentations, assessments, documents and other content supplied as part of the programme remain the intellectual property of DIA Academy or its licensors.
22.2 Materials are provided for the candidate’s personal educational and professional development only.
22.3 Candidates must not copy, reproduce, record, distribute, publish, sell, share or commercially exploit course materials without prior written permission.
22.4 Sharing course login details, assessment materials or restricted learning content with another person is prohibited.
23. Data protection, CCTV and recording
23.1 Personal data is processed in accordance with DIA Academy’s Privacy Policy and applicable UK data protection law.
23.2 CCTV may operate at DIA Academy premises or within training vehicles for safety, security, training quality, assessment assurance and legal compliance where appropriate.
23.3 Candidates are not permitted to make audio and/or video recordings of any part of the DIA Fleet Trainer Course or its assessments.
23.4 This restriction applies to all course activity, including:
- online learning sessions;
- classroom training;
- in-car training;
- discussions with trainers or assessors;
- theory assessments;
- practical driving assessments;
- final training and assessment sessions; and
- any other training or assessment activity delivered as part of the course.
23.5 Candidates must not use a mobile telephone, camera, dash camera, body-worn camera, audio recorder, smart device or any other equipment to deliberately record any training or assessment activity without the prior written permission of DIA Academy.
23.6 Where a candidate’s vehicle contains recording equipment, including a dash camera, audio recording system or in-car camera, the candidate must comply with any instruction from DIA Academy, the trainer or assessor regarding its use. Candidates may be required to switch off or disable recording equipment before training or an assessment begins.
23.7 DIA Academy may itself record training or assessment activity where reasonably required for quality assurance, assessor development, safety, complaints, appeals, regulatory purposes or the protection of candidates, trainers and assessors.
23.8 Where DIA Academy makes a recording, personal data will be processed and retained in accordance with its Privacy Policy and applicable data protection law.
23.9 Candidates must not copy, share, upload, publish, distribute or otherwise make available any unauthorised recording or recorded material relating to the course, its trainers, assessors, other candidates or assessment content.
23.10 Unauthorised recording or distribution of training or assessment content may be treated as a serious breach of these Terms. DIA Academy may stop the relevant session, invalidate an assessment where appropriate, and/or suspend or withdraw the candidate from the course in accordance with section 25.
24. Complaints and assessment queries
24.1 Candidates who have a concern about their training, assessment or course administration should raise it with DIA Academy as soon as reasonably possible.
24.2 Where DIA Academy operates an assessment appeal or review procedure, candidates must follow that procedure and any applicable timescales.
24.3 An assessment appeal concerns whether the assessment process and criteria were applied correctly. It does not provide an automatic right to a reassessment or change of result simply because a candidate disagrees with the outcome.
25. DIA Academy’s right to suspend or withdraw a candidate
25.1 DIA Academy may suspend or withdraw a candidate from the programme where there are reasonable grounds to do so, including:
- serious or repeated breaches of these Terms;
- unsafe behaviour;
- abusive, threatening or discriminatory conduct;
- cheating or assessment malpractice;
- failure to satisfy eligibility requirements;
- fraudulent or misleading information;
- non-payment of sums properly due;
- misuse of course materials or systems;
- unauthorised recording or distribution of course or assessment content; or
- conduct which materially compromises the integrity or safe delivery of the programme.
25.2 Wherever reasonably practicable, DIA Academy will explain the reason for suspension or withdrawal.
25.3 Where withdrawal results from a serious breach by the candidate, course fees already paid will not normally be refundable.
26. Liability
26.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded.
26.2 Subject to clause 26.1, DIA Academy is not liable for indirect or consequential losses arising from participation in the course.
26.3 DIA Academy is not responsible for loss of earnings, business opportunities, travel expenses, accommodation costs or other third-party expenditure incurred in connection with training or assessment, except where liability cannot lawfully be excluded.
26.4 Nothing in these Terms affects a candidate’s statutory consumer rights.
27. Force majeure
27.1 DIA Academy will not be responsible for delay, cancellation or failure to provide Services where this results from circumstances outside our reasonable control, including severe weather, transport disruption, illness, industrial action, government restrictions, emergencies, utility failures or major technical incidents.
27.2 Where reasonably possible, DIA Academy will seek to rearrange affected training or assessments.
28. Third-party services and links
28.1 DIA Academy is not responsible for the content, availability or operation of third-party websites or services linked to or used in connection with the programme, except to the extent required by law.
29. Governing law
29.1 These Terms are governed by the laws of England and Wales.
29.2 The courts of England and Wales will have jurisdiction, subject to any statutory rights a consumer may have regarding where proceedings may be brought.
